Assault and battery of a high and aggravated nature

Assault and battery of a high and aggravated nature or ABHAN is simple assault and battery plus one or more circumstances of aggravation. Circumstances that can elevate a simple assault and battery to ABHAN include the use of a deadly weapon, intent to commit a felony, infliction of serious bodily injury, great disparity in the physical conditions or ages of the parties, difference in gender, purposeful infliction of disgrace and shame, taking indecent liberties or familiarities with a female, and resistance to lawful authority. In order for the jury to convict of ABHAN as opposed to the lesser included offense of simple assault and battery, the state will have to prove at least one aggravating circumstance beyond any reasonable doubt.

ABHAN is considered a misdemeanor under South Carolina law, yet it is punishable by up to ten years in prison.
