Assault and battery with intent to kill

ABWIK or ABIK is the equivalent of attempted murder in South Carolina. It is an unlawful act against another person that is violent in nature including malice aforethought, either expressed or implied. With the exception of the death of the victim, in order for a jury to convict a defendant, each and every element of murder must be proven beyond a reasonable doubt. ABWIK is punishable by up to 20 years in prison.

Assault with intent to kill or AWIK contains all of the elements of ABIK except for the physical touching. For example, if you were to shoot at a person but miss, the charge would be AWIK and not ABWIK.
