Civil Rights and Police Abuse

Lawsuits against municipalities or police departments are among the most difficult to bring, but they are also the most necessary.  Many lawyers will not file suit against the government, especially in the county that they live in.  But, when police or other public officials betray our trust by abusing their authority, who will hold them accountable if not trial lawyers?  We cannot arrest and charge a police officer when he or she commits assault and battery or kidnaps a person by wrongfully arresting them, but we can attempt to bring attention to abusive practices and compensate the person that they have injured, by filing suit against the responsible parties. 

Civil rights suits may involve state causes of action such as wrongful arrest, false imprisonment or assault and battery, or they may be filed in federal court as what is called a 1983 action for violation of civil rights.  They may be brought for the use of excessive force by police or other officials.  They may be brought against individual officers or police departments, or against the city or county who employ them.  They may be brought against prisons or detention facilities for abuses by their employees.
